Terms of Use

These Terms of Use ("Terms") govern your use of the BiteSignal mobile application ("App") published by Mako Technology Labs LLC ("Mako," "we," "us"). By downloading, installing, or using the App, you agree to these Terms.

1. Use of the App

BiteSignal provides fishing condition data, bite scores, tide predictions, weather information, and trip management tools for personal, non-commercial use. You may use the App on any device you own or control, subject to the Apple Media Services Terms and Conditions.

2. Subscriptions

BiteSignal offers a free tier and an optional paid subscription ("BiteSignal Pro"). If you choose to subscribe:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription at any time through your device's Settings → Apple ID → Subscriptions.
• No refunds are provided for partial billing periods. Refund requests must be directed to Apple.
• Prices may change. If pricing changes, you will be notified in advance and must agree to the new price for your subscription to continue.

3. Data and Accuracy

BiteSignal provides fishing conditions, scores, and forecasts based on publicly available environmental data from sources including NOAA and Open-Meteo. This information is provided for informational and recreational purposes only.

• No guarantee of accuracy. Tide predictions, weather data, bite scores, and bite windows are estimates based on available data and algorithms. They may be inaccurate, delayed, or unavailable.
• Not a safety tool. Do not rely on BiteSignal for navigation, marine safety, or weather safety decisions. Always check official NOAA forecasts and marine weather warnings before going on the water.
• No guarantee of fishing success. Bite scores and windows are analytical tools, not predictions of outcome. Fishing results depend on many factors beyond environmental conditions.

4. Your Data

All fishing data you enter — trips, catches, spots, photos, and preferences — is stored locally on your device. If you sign in with Apple or Google, your data is also synced to our cloud service for backup and cross-device access. You are responsible for maintaining access to your account. If you use the app without signing in and delete the app or reset your device, your data will be permanently lost. See our Privacy Policy for details on how your data is stored and protected.

5. Intellectual Property

The App, including its design, code, scoring algorithms, and content, is the property of Mako Technology Labs LLC and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the App.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the App's functionality
• Redistribute, sublicense, or resell access to the App

7. Third-Party Services

The App relies on third-party data providers and services including NOAA, Open-Meteo, Supabase (cloud storage and database), Mixpanel (usage analytics), RevenueCat (subscription management), and Apple Maps / Google Maps. We are not responsible for the availability, accuracy, or performance of these third-party services. Service interruptions from these providers may affect App functionality.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKO TECHNOLOGY LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

10. Indemnification

You agree to indemnify and hold harmless Mako Technology Labs LLC from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, for any reason, without notice. Upon termination, your right to use the App ceases immediately.

12. Changes to These Terms

We may update these Terms at any time. Changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law provisions.
