Terms of Use

These Terms of Use ("Terms") govern your use of the TideSignal mobile application ("App") published by Mako Technology Labs LLC ("Mako," "we," "us"). By downloading, installing, or using the App, you agree to these Terms.

1. Use of the App

TideSignal provides tide predictions, tide station lookup, saved tide locations, sunrise and sunset information, moon phase information, and related coastal planning tools for personal, non-commercial use. You may use the App on any device you own or control, subject to the applicable app store terms and conditions.

2. Paid Features

TideSignal may offer a free tier and optional paid features, subscriptions, or one-time purchases in the future. If paid features are offered:

• Payment will be charged through the applicable app store or payment provider at confirmation of purchase.
• Subscriptions, if offered, may automatically renew unless canceled before the end of the current billing period.
• You can manage or cancel subscriptions through your app store account settings.
• Refund requests must be directed to the app store or payment provider that processed the purchase.
• Prices and available features may change with notice where required by law.

3. Data and Accuracy

TideSignal provides tide predictions and related coastal information based on publicly available environmental data from sources including NOAA. This information is provided for informational and recreational purposes only.

• No guarantee of accuracy. Tide predictions, station information, sunrise and sunset times, moon phase information, and related data are estimates based on available data and algorithms. They may be inaccurate, delayed, incomplete, or unavailable.
• Not a safety tool. Do not rely on TideSignal for navigation, marine safety, weather safety, emergency decisions, or any activity where inaccurate information could result in injury, death, property damage, or legal consequences.
• Use official sources. Always check official NOAA forecasts, tide tables, marine weather warnings, local advisories, posted signs, and conditions at the location before going on or near the water.

4. Your Data

TideSignal stores saved tide locations, display preferences, selected stations, and cached tide forecast data locally on your device. If you delete the App, reset your device, or use the App's data deletion features, this local data may be permanently deleted. TideSignal does not guarantee backup or recovery of locally stored data.

5. Intellectual Property

The App, including its design, code, features, branding, and content, is the property of Mako Technology Labs LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, sublicense, resell, or create derivative works from the App except as permitted by law.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Use the App for navigation, emergency response, or safety-critical decisions
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the App's functionality
• Redistribute, sublicense, or resell access to the App
• Use automated tools to scrape, copy, or harvest App data or functionality

7. Third-Party Services

The App may rely on third-party data providers and services, including NOAA, device location services, Apple Maps, Google Maps, app store payment systems, and other platform services. We are not responsible for the availability, accuracy, legality, or performance of third-party services. Service interruptions or data changes from these providers may affect App functionality.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKO TECHNOLOGY LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, DEATH, PROPERTY DAMAGE, MISSED TIDES, TRAVEL DELAYS, OR ACTIVITY-RELATED LOSSES, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.

10. Indemnification

You agree to indemnify and hold harmless Mako Technology Labs LLC from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the App, your reliance on App information, your activities on or near the water, or your violation of these Terms.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, for any reason, without notice. Upon termination, your right to use the App ceases immediately.

12. Changes to These Terms

We may update these Terms at any time. Changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law provisions.
